
The Kerala High Court has directed the state's Health Department to instruct all doctors to preserve the foetuses of minor victims who undergo medical termination of pregnancy (MTP). This measure aims to ensure that crucial evidence is retained, preventing accused individuals from evading trial. Justice A. Badharudeen emphasized the importance of this directive, stating that doctors must obtain written permission from the investigating officer or the District Police Superintendent before any destruction of the preserved foetus.
The court also recommended that both the state and central governments consider enacting appropriate legislation to formalize this requirement. This ruling came while quashing a case against a doctor accused of illegally aborting a minor's pregnancy and destroying the foetus without preserving it for investigation.
