The Madras High Court has confirmed that only doctors holding an MBBS degree are legally permitted to practise modern allopathic medicine in India. The verdict came while dismissing a petition filed by an association representing practitioners of so-called modern allopathy without MBBS qualifications.
The association, consisting of around 100 members with certificates like BMS, CMP and other diploma-level courses, had requested legal protection from police action and recognition to practise modern medicine. The court questioned the authenticity of their qualifications and asked for clarity on what they meant by “modern allopathy”.
The bench also observed that an earlier favourable order they relied upon was passed without including the Medical Council as a party, and therefore could not be considered valid for claiming rights to practise allopathy.
The High Court concluded that current laws allow only MBBS-qualified professionals to treat patients using modern-medicine methods. As a result, the petition was dismissed.
